Al meteen bij opener Caroline is het feest. Quo doet het nog steeds. En vol overtuiging. Oké, de heren lopen tegen de zestig en dat is te merken. Maar het zijn natuurlijk ook gewoon mensen. De arbeidsproductiviteit is er niet minder om. Een uur en drie kwartier lang stoomt de band door het beste uit haar carrière. En door een dipje als In The Army Now en The Oriental, maar dat zijn mooie gelegenheden om bier te halen. Hoewel dat tegenwoordig met Major Toms in de zaal niet meer altijd hoeft. Geweldige uitvinding overigens. Nu nog een wandelende plee en concerten in de Heineken Music Hall raken steevast uitverkocht.

Maar terug naar Status Quo. Het is heel gemakkelijk om de band af te doen als notoire zelfherhaler. Maar daarmee wordt het gezelschap rond Rick Parfitt en Francis Rossi zwaar onderschat. Afgezien van de boogie-woogierock staan op elk album wel enkele a-typische Quo-nummers die vaak juweeltjes blijken. En die live helaas niet of nauwelijks aan bod komen.

Wel aan bod kwamen vanavond klassiekers als Down Down, Whatever You Want, Don’t Waste My Time, Rain, Paper Plane, Most Of The Time, Again And Again, What You’re Proposing, Dirty Water, Down The Dustpipe en Gerdundula. Al dan niet in een medley verwerkt. En overtuigend gebracht. Natuurlijk, Rick Parfitt moet weleens wat concessies doen aan zijn zanglijnen; ook zijn stem loopt tegen de zestig. Maar na flink te knijpen in de coupletten van Something ‘bout You Baby I Like wist hij in de navolgende nummers kranig overeind te blijven. Zijn gitaarspel is daarentegen niet aan slijtage onderhevig. Krachtig ragde hij de slagpartijen uit zijn Telecaster. En ook zijn podiumpresentatie liet nog geen sporen van veroudering zien. Evenmin verloren gegaan is Rossi’s vingervlugheid. Zijn strakheid echter wel. Hij speelde slordig en liet veel van het originele solowerk achterwege. Desondanks of misschien wel dankzij dit gitaargedrag blijft het een uiterst sympathieke frontman.

Niet sympathiek, maar ‘t moet me wel van het hart: die drummer moet vervangen! Vandaag nog! Wat een houthakker zeg. Zelden zie je zulke slechte slagwerkers in de Heineken Music Hall. Clichématig, weliswaar strak, maar bovenal ongeïnspireerd. Dat gold in extreme mate voor zijn drumsolo. Die was om te huilen. Nu ben ik al niet van de drumsolo’s –die van Rush-drummer Neil Peart daargelaten- maar dit broddelwerk was ongepast en had meer weg van een soundcheck. Bovendien hielp hij het slot van dus-net-niet-hoogtepunt Roll Over Lay Down vakkundig naar God door het einde acht maten te vroeg in te zetten waardoor de climax in rook opging. Graag een nieuwe dus.

Een pluim moet naar bassist John ‘Rhino’ Edwards, die op het podium weliswaar de uitstraling heeft van een zwakzinnige, maar ook de ruggengraat van Quo vormt. Hij is onzichtbaar en onhoorbaar, maar hij is het ook die de band op het podium bij elkaar houdt. En die ervoor zorgt dat Rossi en drummer Matthew Letley zich hun uitglijders kunnen permitteren.

En dan nog een eervolle vermelding voor het absolute hoogtepunt van de avond: het moddervette, ijselijk rockende Big Fat Mama. Iedereen was hier optimaal op dreef. De band speelde het nummer niet volledig, maar wel grotendeels en het was genieten, waarbij alle lof voor oudje Parfitt die de HMH in vuur en vlam zette. Verder was het leuk om bij de jongste minderheid van het publiek te horen. Gemoedelijk publiek overigens, rustig en welgemanierd. Ondanks het hoge promillage.

Eén ding nog. Kan iemand ervoor zorgen dat net als het crowdsurfen het vingerfluiten wordt verboden? Wat een irritante gewoonte. Of ben ik nu ook al een ouwelul?

Nooit hoorde je zo’n gelaagde productie op een rockplaat. En zelden hoor je gitaarwerk dat je zo op je zenuwen werkt en tegelijkertijd zo boeit als op de nieuwe Mars Volta. Amputechture heet het album en volgt na krap een jaar het meesterwerk Frances The Mute op. Met verve. Die gelaagdheid is de grootste troef en maakt dat de atonale en opdringerige gitaartonen, ingemixte bijgeluiden en af en toe complete muzikale chaos goed te hebben zijn. En blijven. Want al krijg je het als luisteraar af en toe zwaar te verduren, nooit verveelt Amputechture. Je draait hem evenwel niet zomaar op een feestje of tijdens een goed gesprek. De plaat eist je volledige aandacht op. En dat verdient ie ook. Koptelefoon aanbevolen.

De wilde doch beheerste uithalen van zanger Cedric Bixler-Zavala domineren de plaat, samen met de inventieve gitaarpartijen van Omar Rodriguez-Lopez, die ook tekende voor de fabuleuze productie. Gitaarpartijen die overigens deels zijn ingespeeld door Red Hot Chili Pepper John Frusciante.

Dat Bixler-Zavala en Rodriguez-Lopez de plaat zo domineren, is niet gek. Zij vormen immers The Mars Volta. En krijgen op Amputechture behalve van Frusciante muzikale bijstand van saxofoniste Sara Christina Gross, geweldenaar Juan Alderete de la Peña op bas en de minimaal zo virtuoze drummer Jon Theodore. Die live overigens wordt vervangen door Blake Fleming. Ben benieuwd of die er net zo´n heftig feest van kan maken als zijn voorganger. Ook geluidsmanipulator Pablo Hinojos-Gonzalez moet worden genoemd. Want negeren kun je hem niet. Hij zorgt voor de kroon op de productie.

Dit is misschien wel de drukste plaat van het duo. De verstilde momenten zijn zeldzamer dan op de vorige twee albums. Songs lijken meer gestroomlijnd. Want af en toe is het heerlijk doorstomen. Desondanks is dit een muzikale breinkraker. Dit is luisteraartje-pesten-en-hem-dan-rijkelijk-belonen. Dit is tovenarij.

Klik hier voor het doelpunt van het jaar. Verantwoordelijk voor deze beauty is Robin van Persie die daarmee afgelopen zaterdag Charlton Athletic het bos instuurde en ‘zijn’ Arsenal op 2-1 bracht. Mooier zie je ze niet snel.

Supreme Court Rejects Texas Sex-Toy Case

WASHINGTON – The Supreme Court refused Monday to consider whether a Texas law making it a crime to promote sex toys shaped like sexual organs is unconstitutional. An adult bookstore employee in El Paso, Texas, sued the state after his arrest for showing two undercover officers a device shaped like a penis and telling the female officer the device would arouse and gratify her.

The employee, Ignacio Sergio Acosta, says a Texas law outlawing the manufacture, marketing or dissemination of an “obscene device” including those shaped like sex organs is unconstitutional because it prevents individuals from using such devices, violating their right to sexual privacy.

Colorado, Kansas and Louisiana have held such laws unconstitutional, while Georgia, Mississippi and Texas have upheld them, said Acosta’s lawyer in urging the Supreme Court to take the case.

An El Paso County court granted Acosta’s motion to dismiss a criminal complaint against him, but an appeals court reinstated it, saying the Texas law did not infringe on private sexual behavior. The bar against promoting obscene devices has been found in other court cases not to infringe on a right to use obscene devices at home, the court of appeals for the Eighth District of Texas ruled.

Acosta also said the Texas law should be examined in light of a U.S. Supreme Court decision that struck down a Texas criminal law banning gay sex as an unconstitutional invasion of privacy.

Some of the courtrooms are not even courtrooms: tiny offices or basement rooms without a judge’s bench or jury box. Sometimes the public is not admitted, witnesses are not sworn to tell the truth, and there is no word-for-word record of the proceedings.Nearly three-quarters of the judges are not lawyers, and many — truck drivers, sewer workers or laborers — have scant grasp of the most basic legal principles. Some never got through high school, and at least one went no further than grade school.

But serious things happen in these little rooms all over New York State. People have been sent to jail without a guilty plea or a trial, or tossed from their homes without a proper proceeding. In violation of the law, defendants have been refused lawyers, or sentenced to weeks in jail because they cannot pay a fine. Frightened women have been denied protection from abuse.

These are New York’s town and village courts, or justice courts, as the 1,250 of them are widely known. In the public imagination, they are quaint holdovers from a bygone era, handling nothing weightier than traffic tickets and small claims. They get a roll of the eyes from lawyers who amuse one another with tales of incompetent small-town justices.

A woman in Malone, N.Y., was not amused. A mother of four, she went to court in that North Country village seeking an order of protection against her husband, who the police said had choked her, kicked her in the stomach and threatened to kill her. The justice, Donald R. Roberts, a former state trooper with a high school diploma, not only refused, according to state officials, but later told the court clerk, “Every woman needs a good pounding every now and then.”

A black soldier charged in a bar fight near Fort Drum became alarmed when his accuser described him in court as “that colored man.” But the village justice, Charles A. Pennington, a boat hauler and a high school graduate, denied his objections and later convicted him. “You know,” the justice said, “I could understand if he would have called you a Negro, or he had called you a nigger.”

And several people in the small town of Dannemora were intimidated by their longtime justice, Thomas R. Buckley, a phone-company repairman who cursed at defendants and jailed them without bail or a trial, state disciplinary officials found. Feuding with a neighbor over her dog’s running loose, he threatened to jail her and ordered the dog killed. “I just follow my own common sense,” Mr. Buckley, in an interview, said of his 13 years on the bench. “And the hell with the law.”

The New York Times spent a year examining the life and history of this largely hidden world, a constellation of 1,971 part-time justices, from the suburbs of New York City to the farm towns near Niagara Falls.

It is impossible to say just how many of those justices are ill-informed or abusive. Officially a part of the state court system, yet financed by the towns and villages, the justice courts are essentially unsupervised by either. State court officials know little about the justices, and cannot reliably say how many cases they handle or how many are appealed. Even the agency charged with disciplining them, the State Commission on Judicial Conduct, is not equipped to fully police their vast numbers.

But The Times reviewed public documents dating back decades and, unannounced, visited courts in every part of the state. It examined records of closed disciplinary hearings. It tracked down defendants, and interviewed prosecutors and defense lawyers, plaintiffs and bystanders. The examination found overwhelming evidence that decade after decade and up to this day, people have often been denied fundamental legal rights. Defendants have been jailed illegally. Others have been subjected to racial and sexual bigotry so explicit it seems to come from some other place and time. People have been denied the right to a trial, an impartial judge and the presumption of innocence.

In 2003 alone, justices disciplined by the state included one in Montgomery County who had closed his court to the public and let prosecutors run the proceedings during 20 years in office. Another, in Westchester County, had warned the police not to arrest his political cronies for drunken driving, and asked a Lebanese-American with a parking ticket if she was a terrorist. A third, in Delaware County, had been convicted of having sex with a mentally retarded woman in his care.
